The messy lawsuit between LSU and former defensive coordinator John Chavis is far from over.

According to a report from The Advocate, Baton Rouge District Judge Tim Kelley on Monday upheld the lawsuit against Chavis, claiming a jury will rule on whether his contract was breached by either party. LSU claims Chavis owes a $400,000 contract buyout for leaving the school before Jan. 31, 2015, while Chavis demands about $645,000 in unpaid vacation, bonuses and other penalty wages.

Chavis left the Tigers’ staff shortly after the 2014 Music City Bowl loss to Notre Dame, taking the defensive coordinator position at Texas A&M. The coach appeared to be recruiting for the Aggies in photographs in January 2015, though he and the university insist he didn’t begin working until Feb. 13, 2015.

Chavis’ attorney Jill Craft said the coach’s three-year contract with the school that included the $400,000 buyout is void because of alterations LSU made to it after it had been signed.

The LSU Board of Supervisors’ attorney argued that while the wording had been altered, the “substance” of the contract remained the same.

Chavis was not present at the hearing Monday. His contract with Texas A&M shows that the school is responsible for paying his buyout should he be found to owe the $400,000.
