The state of California has dropped a rape charge against former Florida DL Ray McDonald after his accuser refused to testify.

“Despite my best efforts to convince the victim to testify, she refused,” Deputy Santa Clara County District Attorney Chris Lamiero said in a statement. “That is her legal right.”

The accusation was made by a woman who attended a party at McDonald’s house in 2014, when he was a member of the San Francisco 49ers. He was released by the 49ers after the accusations were made in December 2014, and was arrested in 2015.

The former first-team All-SEC defensive lineman is not rid of legal issues. Reuters reporter Sharon Bernstein notes that McDonald also faces prosecution on a misdemeanor charge of violating a restraining order in an unrelated domestic violence case.

McDonald played a key role in Florida’s 2006 BCS championship season, and was a third-round draft pick in 2007. He signed with the Chicago Bears in March 2015, but was cut roughly two months later after a domestic violence incident.
