Markale Hart, the 24-year-old man charged in the shooting death of former Auburn H-back Jakell Mitchell, was denied immunity from prosecution Monday after an order by Lee County Circuit Court Judge Christopher Hughes.

As reported by the Associated Press, Hart tried to use Alabama’s “stand your ground” law to avoid prosecution. Law enforcement said Mitchell was shot as part of an argument at an apartment complex in December 2014.

In the order, Hughes said Hart wasn’t granted immunity because Hart wasn’t allowed to carry a weapon as a convicted felon. Hughes also didn’t agree with Hart’s claim that Hart acted in self-defense.

Mitchell, from Opelika, Alabama, was 18 years old.
