Former Alabama DT Marcell Dareus is being sued for sexual assault and spreading an STD, according to a report by News4Jax.com.

The accuser, a Texas woman, is only identified as Jane Doe in the lawsuit. She accuses Dareus of having sex with her while she was unconscious and spreading herpes to her. The accuser says that the two went on a date on or around April 7 in Houston. The suit states that she awoke the next morning unable to remember what had happened that night. Dareus told her the two had sex.

The suit, filed in Duval County in Florida, states that because the accuser was unconscious, she did not consent and thus Dareus committed sexual assault. The suit confirms that the two had consensual sex in the days following the incident. The accuser states that Dareus did not disclose he had herpes when they had unprotected sex.

At the time of the News 4 Jax report, it was unclear if a criminal complaint had been filed in Houston. Attorneys for the accuser told News 4 Jax that there are civil and criminal laws in both Texas and Florida applicable to knowingly exposing someone else to a sexually transmitted disease.

Dareus, drafted by the Buffalo Bills in 2011, currently plays for the Jacksonville Jaguars (Jacksonville is in Duval County). He played at Alabama from 2008-10.

Dareus is also the defendant in another Florida (Hillsborough County) lawsuit filed by a Las Vegas woman alleging sexual assault following an after party in Tampa in January 2017.
