State’s attorney: Case against Antonio Callaway ‘un-prosecutable’ given evidence presented

Last week the reason behind Florida’s suspensions of sophomore receiver Antonio Callaway and senior quarterback Treon Harris were revealed, as both players were accused of sexual assault in December. According to Florida state’s attorney William Cervone, the evidence presented to him by university police against the two Gators did not warrant criminal charges.

Although Cervone did acknowledge his office did not personally review the allegations and according to ESPN, the accuser never contacted local Gainesville police and they have no reports to review regarding the allegations.

“I had a conversation with officers at the university to see whether it was going to come this way,” said Cervone. “Based on what I knew then, I didn’t think there was even a remote possibility of criminal charges. It would have been totally un-prosecutable based on the facts given to me. It would have never risen to sexual assault or sexual battery.”

At this point, Callaway has been cleared to practice with the Gators but not officially ruled to play in any games until his school hearing regarding the case has been ruled upon. Callaway’s Title IX hearing was held Friday, without his accusers participation due to her representatives’ belief that the hearing was biased based on a former Florida athlete presiding over the hearing.
