District Court Judge Steve Speakman is considering granting a request of the man accused of setting fire to Toomer’s Oaks following this year’s Auburn-LSU game.

Jochen Wiest, a 29-year-old native of Germany, has asked to return to his home country because he claims he is unable to support himself or his family in the United States. Wiest’s lawyers stated he may also “be in violation of his terms of entry into the United States if not employed.”

Speakman, who is hearing the case that will proceed to a grand jury, will decide on the matter Dec. 8, according to Jim Little of The Opelika-Auburn News.

Wiest’s time in the United State has become a concern because his case will not be presented before a grand jury until March 2017.
