Darius Miles is awaiting trial after being charged in the murder of a 23-year-old Alabama woman, but the state of Alabama will not seek the death penalty, according to the Tuscaloosa News on Monday evening.

Miles, a former Alabama basketball player, is facing a charge of capital murder along with Michael Davis after Jamea Harris was killed in January. Miles owned the gun that was used in Harris’ shooting death, but Davis was the one that allegedly pulled the trigger, according to investigators assigned to the case.

Although the charge carries a potential death penalty sentence, it was not recommended by district attorneys. The maximum sentence that Miles could now face is life in prison without parole, per the report.

Miles was granted an immunity hearing in June, which was held on Monday.

“In the immunity hearing, Miles’ attorneys would have the opportunity to argue in front of a judge that Miles acted in self defense, made possible through Alabama’s stand your ground law. If the attorneys succeed, the judge could dismiss the cases against Miles,” according to the Tuscaloosa News’ Nick Kelly.

Miles is currently being held without bond.
