An altercation between Tennessee wide receiver Josh Smith and his male roommate earlier this month could end up costing him a lot of money.

Kennedy Foster, Smith’s roommate and longtime friend, has demanded $875,000 in compensatory and punitive damages by Tuesday, May 30, or he will seek a $3 million civil lawsuit, according to a report by Tennessee radio host Jimmy Hyams.

The two parties each revealed a different side of the story to authorities, but the incident occurred at their house after celebrating Cinco De Mayo. Smith allegedly kicked Foster in the face multiple times, which his attorney claims led to a broken nose and broken teeth as well as damage to his eyes and right ear.

According to the incident report, the fight also involved a third roommate, Malcolm Stokes. After receiving the settlement demand, Smith’s attorney, Keith Stewart, was reportedly skeptical of Foster’s motive, given that he had not been successful in attempting to press charges against Stokes.

“I’m not accusing him (Foster) of extortion, but that’s what it looks like,’’ Stewart said, according to the report. “Given my understanding that Mr. Foster’s attempts to press charges against Malcolm Stokes were unsuccessful, it seems his motives are clear.’’

It is not known if Smith, has been punished by Tennessee coach Butch Jones for his role in this incident, but the senior receiver has reportedly been taking alcohol anger management classes.

Foster’s settlement demand asks for a cashier’s check in the value of $875,000 to be received by no later than 5 p.m. on May 30, in addition to a “letter of sincere apology,” according to Hyams’ report. If the check is not produced by that time, Foster’s party will file a civil suit seeking $1.5 million in compensatory damages and $1.5 million in punitive damages.
