The man accused of lighting one of Toomer’s Oaks on fire last month will continue to be prosecuted.

The case against Jochen Wiest will proceed into the Lee County Circuit Court, though no date for the grand jury has been set, the Auburn Plainsman reported Wednesday. District Court Judge Steve Speakman reached that decision at a Wednesday hearing, which Wiest did not attend.

The 29-yard-old German national is being charged with public intoxication, desecration of a venerated object and felony criminal mischief after setting fire to the new Magnolia Avenue Oak following Auburn’s win against LSU on Sept. 24.
