Report: Ole Miss expects Houston Nutt’s legal team to pay $25,100 for release of phone records

Thomas Mars, the Arkansas-based lawyer representing former Ole Miss coach Houston Nutt in his lawsuit against the school, is locked in a heated battle with the university over the release of ex-coach Hugh Freeze’s phone records.
According to a letter Mars sent to the Ole Miss general counsel (which was obtained by USA TODAY), the university wants Mars or Nutt to pay $25,100 for five years of phone records — a price Mars said he’s completely unwilling to pay, especially since most of the cost is for Ole Miss’s lawyers to comb through the records:
โThereโs nothing they can do with those records except produce them,โ Mars told USA TODAY Sports. “Thereโs no reason for lawyers to look at them. Theyโre not allowed to redact them. Phone records arenโt privileged under any circumstances. This is just a bogus exercise theyโre manufacturing to try to put a huge price tag on these records and deter me and other people from getting their hands on them. They canโt make me pay for their lawyers to review them. Thatโs their problem.โ
Clearly, Mars doesn’t want to pay for other lawyers to look at the information he wants, but whether or not he can get the cost lowered or waived altogether remains to be seen.
One thing is for sure, though — it doesn’t sound like Ole Miss will be getting $25,100 from Mars or Nutt anytime soon.
